To send a Nintendo 3DS from U.S. to Mexico, but still in box, does equal customs charge taxes?

What happens is that my dad is located in Kansas and I in Mexico and wants me to send a Nintendo 3DS with some games, the console is already open as well as the games but everything comes in its box yet, I read on the internet that used products have no charge at the time of going through customs, but I wanted to know if still this in its box remains free of tax.
